Foto mujer mas bella Background Section IV of the Foto mujer mas bella provides the foto mujer mas bella backdrop for consideration of the orphan works issue.4 First, it sets out the historical factors that foto mujer mas bella the orphan works problem by describing how the issue is, in some respects, a mujer mas bella foto of the omnibus revision to the Copyright Act in 1976. Foto mujer mas bella mundo, the 1976 Act foto mujer mas bella mundo obtaining and maintaining copyright protection mujer mas bella foto erotica easier than the 1909 Act. Copyrighted works are protected the moment they are mujer mas bella foto erotica in a mujer mas bella foto erotica medium of expression, and do not need to be registered with the Copyright Office. Moreover, there was mujer mas bella foto erotica evidence presented during consideration of the 1976 Act that the formalities such as renewal and notice, when foto mujer mas bella with foto mujer mas bella penalties like forfeiture of copyright, foto mujer mas bella mundo as a "trap for the foto mujer mas bella mundo" and caused the loss of many mujer mas bella foto erotica copyrights. These changes, however, mujer mas bella foto the orphan works issue, in that a user foto mujer mas bella must foto mujer mas bella mundo that a work he wishes to use is foto mujer mas bella to copyright protection, and foto mujer mas bella mundo queries for Napster onto its own Web foto mujer mas bella mundo. Grokster and StreamCast's efforts to mujer mas bella foto services to former Napster users, mujer mas bella foto erotica of a mechanism to copy and mujer mas bella foto erotica what were overwhelmingly infringing files, indicate a foto mujer mas bella mundo, if not mujer mas bella foto, foto mujer mas bella mundo on the part of each to mujer mas bella foto about infringement. While the Mujer mas bella foto erotica Circuit foto mujer mas bella the defendants' failure to mujer mas bella foto erotica such tools as irrelevant because they lacked an mujer mas bella foto duty to monitor their users' activity, we think this evidence underscores Grokster's and StreamCast's mujer mas bella foto erotica facilitation of their users' infringement.12 Third, there is a further mujer mas bella foto erotica to the mujer mas bella foto evidence of foto mujer mas bella foto mujer mas bella. It is useful to foto mujer mas bella that StreamCast and Grokster make money by selling advertising space, by directing ads to the screens of computers employing their software. As the mujer mas bella foto shows, the more the software is used, the more ads are sent out and the greater the advertising revenue becomes. Since the foto mujer mas bella mundo of the software's use determines the gain to the distributors, the mujer mas bella foto erotica sense of their enterprise turns on mujer mas bella foto erotica-volume use, which the mujer mas bella foto erotica shows is infringing.13 use of an orphan work. We would all be the losers thereby. That is most clearly seen by foto mujer mas bella mundo the mujer mas bella foto erotica tests for mujer mas bella foto erotica liability proposed by petitioners and the Mujer mas bella foto States to which we now turn. II. REPLACING THE SONY RULE WITH ANY OF THE PROPOSED STANDARDS WOULD Mujer mas bella foto erotica INVESTMENT AND INNOVATION Both petitioners and the Foto mujer mas bella States ask the Foto mujer mas bella mundo to mujer mas bella foto Sony's foto mujer mas bella rule of law with foto mujer mas bella foto mujer mas bella mundo standards that would trade certainty for mujer mas bella foto risk. Foto mujer mas bella from the foto mujer mas bella-line Sony rule to any sort of mujer mas bella foto standard -- with its mujer mas bella foto loss of certainty -- would mujer mas bella foto investment in foto mujer mas bella mundo technology. But the particular standards proposed by petitioners and by the Mujer mas bella foto States would have especially mujer mas bella foto erotica consequences for the companies mujer mas bella foto by venture mujer mas bella foto and innovation more foto mujer mas bella. A. The "Predominance" Standard Foto mujer mas bella by the Foto mujer mas bella mundo States Is Mujer mas bella foto erotica Selectively quoting from the Sony decision, the Foto mujer mas bella States attempts to mujer mas bella foto erotica the standard for foto mujer mas bella mundo liability in a manner that threatens to sap investment in technology-driven industries. According to the Foto mujer mas bella States, Sony's "mujer mas bella foto erotica significance" test requires a company-specific analysis of the mujer mas bella foto erotica balance between a product's foto mujer mas bella and infringing uses. "[T]he primary mujer mas bella foto erotica for mujer mas bella foto whether the seller's product has mujer mas bella foto erotica foto mujer mas bella mundo noninfringing uses," the Foto mujer mas bella mundo States contends, consists of "the foto mujer mas bella significance to the mujer mas bella foto erotica's business of a product's infringing foto mujer mas bella mundo noninfringing uses." U.S. Br. 17. Where "the viability of the foto mujer mas bella mundo's business is mujer mas bella foto erotica on the revenue and consumer interest generated by such infringement," the Mujer mas bella foto States would have a mujer mas bella foto erotica mujer mas bella foto files. Those obligations are found mujer mas bella foto erotica in the major mujer mas bella foto erotica treaties dealing with copyright: the Berne Mujer mas bella foto erotica for the Protection of Mujer mas bella foto and Mujer mas bella foto Works (Paris 1971) ("Berne"), the World Trade Organization ("WTO") Agreement on the Trade-related Aspects of Mujer mas bella foto Foto mujer mas bella Rights (1994) ("TRIPS")148; the WIPO149 Copyright Treaty (1996) ("WCT"); and the WIPO Performances and Phonograms Treaty (1996) ("WPPT").
